But what he should not do is mislead people, especially Black listeners, with a lazy, historically incomplete talking point like calling Democrats “the party of the KKK” as if that settles anything about what is happening in America right now. Cannon made those remarks on a recent episode of *The Big Drive*, where he also praised Trump and echoed the idea that Democrats are still defined by their 19th-century history.

Yes, there is historical truth inside the soundbite. After the Civil War, white supremacist terror groups like the Ku Klux Klan arose in a political environment where Southern Democrats were deeply tied to segregation and anti-Black oppression. No serious person should deny that history. But stopping the story there is either ignorance or manipulation. Political parties are not frozen in time. Their coalitions change. Their voters change. Their regional bases change. Their priorities change. If you want to talk honestly about race and party politics in America, you have to talk about the realignment that followed the civil rights era, not pretend that 1865 tells you everything you need to know about 2026.

That is why the “Democrats were the party of slavery” line is so dishonest when it is used as a present-day political argument. It skips over the part where segregationist Southern Democrats, including Strom Thurmond, broke away as Dixiecrats and then many of those forces migrated into the Republican coalition during and after the civil-rights era. Thurmond himself ran on the Dixiecrat ticket in 1948 and officially joined the Republican Party in 1964.

So no, you cannot take the worst elements of the Democratic Party from 100-plus years ago and paste them onto the Democratic Party of today as if nothing happened in between. That is not history. That is propaganda.

And more importantly, Black people do not live in 1863 or 1948. We live now! We live under current policies, current rhetoric, current priorities, and current administrations. So if Nick Cannon wants to have a real conversation, then let’s talk about the present.

Let’s talk about what actually affects Black families, Black workers, Black veterans, Black students, and Black communities today. What does renaming the Gulf of Mexico to the “Gulf of America” do for housing? For wages? For health care? For schools? For the cost of groceries or gas? Trump did sign an order to rename it for U.S. government usage, but even the Associated Press noted that the order’s authority is limited to the United States and does not bind other countries or international bodies. It is symbolism, not relief.

Let’s also talk about substance over slogans. Defense Secretary Pete Hegseth issued a January 29, 2025 memorandum declaring that DEI policies are “incompatible” with Defense Department values and directing a “merit-based, color-blind” approach instead. People can debate that policy, but let’s not pretend it is unrelated to concerns many Black Americans have about whether opportunity, advancement, and inclusion are being rolled back in the name of ideology.

That is the problem with Cannon’s comment. It encourages Black audiences to look backward selectively while ignoring what is happening in front of them. It suggests that because Democrats once housed open segregationists, today’s Republican Party should get a pass from scrutiny. That makes no sense. Every party, every politician, and every administration should be judged by what they are doing now, not by a half-remembered history lesson stripped of all context.

And while we are being honest, the Emancipation Proclamation itself is often oversimplified too. Lincoln issued it on January 1, 1863, and it was a monumental wartime act, but it did not instantly free every enslaved person everywhere in the United States. Real history is more complicated than social-media politics.

So here is the bottom line: Nick Cannon is wrong. He is wrong because he is treating history like a meme instead of a serious subject. He is wrong because he is flattening party realignment into a slogan. And he is wrong because his comments can mislead Black followers into thinking that the racial realities of modern American politics can be understood by repeating one fact from the 1800s while ignoring the last sixty years.

You can support Trump if you want. You can criticize Democrats if you want. You can reject both parties if you want. But do not insult people’s intelligence by pretending that today’s political fight can be understood without talking about civil rights, party realignment, the Dixiecrats, and the policies being pushed right now.

That is not truth. That is spin.

On my way home from work this evening, March 12, 2026, I received a call from a very good friend telling me that David Hennessy had died.

I want to be clear about something from the start: I am not worthy to write this post. There are people who knew David far longer than I did, who tried more cases alongside him, who traded more laughs and more arguments with him, who carry deeper and richer memories of the man. They could and probably will write better stories. But this is my story. And sometimes the people on the edges of someone’s life see things the people at the center take for granted.

“You Need to Meet My Husband. He’s Kind of a Big Deal.”

Before I ever met David Hennessy, I met his wife. She worked at the State Public Defender’s office, and when she found out who I was, she looked at me and said, “Do you know my husband?” I told her I didn’t. “Well,” she said, “you need to meet him. He’s kind of a big deal.”

I had no idea how much of a big deal. And I’d like to say, for the record, that Vickie is quite a big deal herself.

David came to my wedding in 2008. It was around that time I began to understand the weight his name carried in Indiana legal circles. A Marion County magistrate — Magistrate David Hooper — once told me that David Hennessy was one of the finest attorneys he had ever seen practice law. That stuck with me. It still does.

I watched Hennessy try cases. I studied him. I wanted to be like him. Someone once described him as a very gifted attorney but a complicated man. Both parts of that sentence were true, and neither part diminished the other.

Syracuse, Indiana — 2017

Fast forward to 2017. I was on my way to starting my own private practice. We were at an IPDC board retreat in Syracuse, Indiana, one of those settings where real conversations happen between sessions. Before the board retreat, David and I talked at his office. He told me something I never forgot.

He said he’d been hearing stories from people in the jail, clients talking about some other attorney they called “The Black David Hennessy.” He looked at me and said, “If anyone is going to be called The Black David Hennessy, it should be you.” He wanted me to leave the Marion County Public Defender Agency and take over his practice so he could retire.

I thought long and hard about it. I prayed about it. In the end, I knew it wasn’t the right fit for me. He must have known it, too. It never happened. But the honor of him even considering it…that was something I held close. He believed in me when I was still finding my footing. When I was too scared to leave the Marion County Public Defender Agency to go on my own in private practice. Well, instead of taking over his practice, he sent me cases to help me build my practice. He invested in me the way mentors do when they see something worth investing in.

(He also sent me one of the most difficult family law clients I’ve ever had, which is a large part of why I no longer do family law. So, thank you for that too, David.)

The Falling Out

Our relationship broke down over a meeting. Important people in the room, and David felt I didn’t have his back. He thought I’d sold out. That I was scared. He called me later to say so, with considerable foul language.

I told him plainly: I was not scared. I had survived twelve years in prison. I had served in combat. I hung up.

He called back. More of the same. The texts that followed were things I have long since deleted, but their essence remains. I was offended. Deeply. I blocked his number, and it has stayed blocked.

I am not going to pretend that didn’t happen. David was a complicated man. That’s part of his story. It is also part of mine.

Pickleball

Time passed. As it does. I saw him again at a training in Hamilton County. We talked briefly. It was civil. Maybe even warm. The way two people can be warm when they’ve decided, without saying so, to let something go for the moment. Besides, I’m not sure whether David held grudges.

I forgive you because you were a complicated man who did so many good things. You helped so many people, more than I ever have. Because you came to my wedding. Because you saw something in me worth mentoring. Because you sent me cases when I was building something from nothing. Because a magistrate told me you were one of the best he’d ever seen, and watching you work, I believed it.

I forgive you because the last image I have of you is a man leaving a meeting early to go play a sport he loved. And there is something right about that. Something human. But, most of all, I’m sorry for letting my hurt feelings prevent me from spending more time with you.

There are people who knew you far better than I did, David. They will tell your story with more laughs, more depth, more years behind the telling. They will honor you the way you deserve to be honored.

Let me tell you something, folks. I’ve been doing this long enough to know when something stinks. And what’s coming out of the Henry County Jail right now? It reeks.

Nicholas Gulley II, a 35-year-old man, is currently lying in a hospital bed on life support. Ventilator. Broken ribs. Double pneumonia. A blood infection ravaging his body. And Sheriff John Sproles wants you to believe that his deputies did absolutely nothing wrong.

I’m Mark Nicholson, and I’m not buying it. Neither should you.

The Facts Don’t Lie : But Apparently, Some Officials Do

Here’s what we know: Nicholas Gulley II was in the custody of the Henry County Sheriff’s Office. Now he’s fighting for his life. Sheriff Sproles has launched what he’s calling an “investigation” into the alleged abuse at the jail. How comforting.

But here’s where it gets interesting. In the Sheriff’s own statement, he admitted that Mr. Gulley had bruising on his chest and upper abdomen. Yet somehow, in the same breath, we’re supposed to accept that “no rights were violated.”

Let me ask you a simple question: Did he bruise himself?

Did Nicholas Gulley II decide to give himself broken ribs while in jail custody? Did he somehow contract double pneumonia and a blood infection from the comfort of his cell? Did he put himself on life support for fun?

Give me a break.

A Pattern of Behavior That Should Terrify Every Henry County Resident

This isn’t an isolated incident, and anyone paying attention knows it. Since Sheriff Sproles took office in 2022, his department has been hit with at least 12 tort claims in just the first 16 months. Twelve. In sixteen months.

We’re talking allegations of:

• Wrongful background checks

• Harassment of fellow law enforcement officers

• Wrongful death claims related to police chases

• Excessive force by jail guards (one of whom actually pleaded guilty)

But here’s the deal: playing Batman in Indianapolis is a really good way to end up on the wrong side of a jail cell yourself.

Before you tackle that shoplifter or chase down that guy who just ran a red light, let’s talk about what Indiana law actually says about citizen’s arrest: and why even when it’s technically legal, it can still blow up in your face.

Yes, Citizen’s Arrest is Real in Indiana (But It’s Not What You Think)

Indiana Code 35-33-1-4 does allow private citizens to make arrests under very specific circumstances. This isn’t some urban legend or legal myth. It’s on the books.

But here’s the catch most people miss: the law is incredibly narrow, and the consequences of getting it wrong are brutal.

Under Indiana law, you can make a citizen’s arrest in exactly three scenarios:

1. A Felony Committed in Your Presence

If someone commits a felony right in front of you: not “you think they did” or “someone told you they did”: you may have the legal authority to detain them. We’re talking about serious crimes here: aggravated assault, robbery, arson, that kind of thing.

The key phrase is “in your presence.” You saw it happen with your own eyes. No guessing. No assumptions.

2. Probable Cause That a Felony Was Committed

This one’s trickier. If you have probable cause to believe someone committed a felony: even if you didn’t witness it: you might be able to make an arrest. But “probable cause” is a legal standard that trips up trained police officers on a regular basis. What makes you think you’ll nail it?

3. A Misdemeanor “Breach of Peace” in Your Presence

Here’s where things get interesting. Indiana law allows citizen’s arrest for misdemeanors, but only if the crime amounts to a “breach of peace” and happens right in front of you.

What counts as breach of peace? It’s vague. Courts have interpreted it to include things like public intoxication, disorderly conduct, and: relevant here: operating a vehicle while intoxicated (OWI).

In State v. Hart, 669 N.E.2d 762 (Ind. Ct. App. 1996), an Indiana court upheld a citizen’s arrest where someone detained a drunk driver they witnessed weaving across the road. The “breach of peace” standard was met because an intoxicated driver poses an immediate danger to public safety.

Sounds reasonable, right? But here’s the problem: for every Hart situation that works out, there are dozens of would-be heroes who guessed wrong and ended up facing charges themselves.

The Brutal Reality: What Happens When You Get It Wrong

Let me be blunt with you. Even if you think you’re within your legal rights, citizen’s arrest carries massive risks that can destroy your life:

False Imprisonment Charges

Detain someone without proper legal authority? Congratulations, you’ve just committed false imprisonment: a Class A misdemeanor in Indiana that can land you up to a year in jail. And if you used any force? Now we’re potentially talking about criminal battery or worse.

The person you detained doesn’t even have to be innocent. If you screwed up the legal technicalities: wrong type of crime, didn’t actually witness it, used excessive force: you’re on the hook.

Civil Lawsuits

Even if you dodge criminal charges, the person you detained can sue you for false imprisonment, assault, battery, intentional infliction of emotional distress... the list goes on. We’re talking potentially tens of thousands of dollars in damages, plus attorney fees.

And here’s a fun fact: your homeowner’s insurance probably won’t cover intentional acts like tackling someone in a parking lot.

Physical Danger

This should be obvious, but apparently it’s not: confronting criminals is dangerous. You don’t know if they’re armed. You don’t know if they’re on drugs. You don’t know if they’ll fight back.

Police officers train for years to handle these situations and they still get hurt. You, with zero training and no backup, are going to walk up to a potential felon and... what exactly?

Prosecutors and Judges Hate This Stuff

Here’s something most people don’t realize: even when a citizen’s arrest is technically legal, the people who run Indiana’s courtrooms are not fans.

Prosecutors see citizen’s arrests as messy, legally complicated, and a headache to prove up in court. The chain of custody gets questionable. The witness (you) becomes both the arresting party and the key testimony. Defense attorneys will tear your credibility apart.

Judges? They’ve seen too many of these situations go sideways. Someone gets hurt. Stories don’t match up. What started as “I was just trying to help” turns into a circus.

Even if the underlying crime was real and the bad guy was guilty, your involvement can taint the entire case. I’ve seen legitimate criminals walk free because some well-meaning bystander decided to play cop and botched the whole thing.

The Batman Problem

Here’s my honest take on the whole vigilante fantasy: it sounds cool in the movies, but it’s a legal nightmare in real life.

Batman operates in Gotham City, where apparently there are no consequences for assault, breaking and entering, or false imprisonment. You operate in Indianapolis, Indiana, where criminal law is very real and the consequences are very serious.

When you make a citizen’s arrest, you’re taking on enormous legal liability with zero qualified immunity, zero training, and zero backup. You’re betting your freedom, your finances, and potentially your physical safety on your ability to correctly assess a chaotic situation in real-time.

That’s not heroism. That’s gambling with terrible odds.

So What Should You Actually Do?

If you witness a crime in progress:

1. Call 911. That’s literally what they’re there for.

2. Be a good witness. Note descriptions, license plates, direction of travel.

3. Don’t intervene unless someone’s life is in immediate danger and there’s no other option.

4. Document everything. Video on your phone can be powerful evidence.

Let the professionals handle the arrest. Let the prosecutors handle the charges. Let the courts handle the justice.

Hollywood is buzzing with news that actor Kiefer Sutherland, best known for his iconic role as counter-terrorism agent Jack Bauer in the hit series “24,” has been arrested in Los Angeles after allegedly assaulting a ride-share driver early Sunday morning.

The 59-year-old actor was taken into custody on January 12, 2026, following an incident near Sunset Boulevard and Fairfax Avenue in the Hollywood neighborhood. According to the Los Angeles Police Department, Sutherland faces serious charges, and the investigation is far from over.

Here’s what we know so far.

The Incident: What Happened on Sunset Boulevard

The altercation reportedly took place just after midnight when LAPD officers responded to a dispatch call around 12:15 a.m. reporting an assault in progress.

According to police, Sutherland entered a ride-share vehicle and allegedly physically assaulted the driver before making criminal threats toward the victim. Dispatch audio obtained by authorities painted a chaotic scene: the reporting person, described as wearing a “white-based jacket, blue jeans, and brown sneakers,” was reportedly running from the suspect.

The driver apparently fled to their vehicle with Sutherland allegedly chasing them before eventually stopping.

Thankfully, the driver did not sustain any injuries requiring medical treatment. However, the emotional and psychological toll of such an encounter shouldn’t be underestimated, being threatened and attacked while simply doing your job is a traumatic experience.

Arrest and Booking Details

Sutherland was arrested on suspicion of felony criminal threats and booked at 4:23 a.m. at a local Los Angeles jail. After more than six hours in custody, the actor was released on a $50,000 bond.

His initial court appearance is scheduled for February 2, 2026.

As of now, Sutherland’s representatives have not issued a public statement regarding the arrest or the allegations against him. The investigation remains ongoing, according to LAPD authorities.

Who Is Kiefer Sutherland?

For those who might not immediately recognize the name, Kiefer Sutherland is Hollywood royalty, and not just because his father is legendary actor Donald Sutherland.

Unfortunately for Sutherland, this isn’t his first brush with the law. The actor has faced multiple legal issues over the years, many of them alcohol-related.

Here’s a quick rundown:

• 1990s: Multiple alcohol-related arrests

• 2004: Convicted of drunken driving

• 2007: Sentenced to jail after pleading no contest to another drunken driving charge

• 2009: Charged with assault (the charges were later dropped)

This pattern of behavior raises questions about whether underlying issues might be contributing to these incidents. However, if aggravating factors are present, the charges and penalties can be significantly more severe.

Criminal Threats in California

This is where things get really serious. Under California Penal Code Section 422, criminal threats (formerly known as “terrorist threats”) is a wobbler offense, meaning it can be charged as either a misdemeanor or a felony depending on the circumstances.

To secure a conviction for criminal threats, prosecutors must prove:

1. The defendant willfully threatened to kill or seriously injure another person

2. The threat was made verbally, in writing, or via electronic communication

3. The defendant intended for the statement to be understood as a threat

4. The threat was so clear and immediate that it caused the victim to reasonably fear for their safety

5. The victim’s fear was reasonable under the circumstances

If charged as a felony, criminal threats carries:

• Up to 3 years in state prison

• Fines up to $10,000

• A “strike” under California’s Three Strikes Law

That last point is crucial. A strike on your record can have devastating long-term consequences, doubling sentences for future felonies and potentially leading to a 25-years-to-life sentence for a third strike.
